Terms & Privacy

This User Agreement ("Agreement") is entered into between you (referred to as "User," "you," or "your") and New Voters, Inc. ("New Voters," "we," "us," or "our"), governing your use of the website "new-voters.org" (referred to as the "Site"). By accessing or using the Site, you agree to be bound by the terms and conditions set forth in this Agreement.

Acceptance of Terms
By accessing or using the Site, you acknowledge that you have read, understood, and agree to be bound by this Agreement, our Privacy Policy, and any other applicable laws and regulations. If you do not agree to these terms, you must refrain from accessing or using the Site.Use of the Site

(a) Eligibility: By using the Site, you represent and warrant that you are at least 13 years old. If you are under the age of 13, you must obtain the consent of your parent or legal guardian to access or use the Site.

(a) Ownership: The Site and its content, including but not limited to text, graphics, logos, images, software, and audio or video files, are owned by or licensed to New Voters and are protected by intellectual property laws.
(b) Trademarks: The name "New Voters" and the New Voters logo are trademarks owned by New Voters, Inc. You agree not to use these trademarks or any similar marks in connection with any products or services without our prior written consent.

Disclaimer of Warranties
(a) Site Availability: We strive to ensure the availability and accuracy of the Site. However, we do not guarantee uninterrupted access to the Site or its error-free operation. The Site is provided on an "as is" and "as available" basis, without any warranties of any kind, whether express or implied.
(b) Third-Party Content: The Site may contain links to third-party websites, content, or services. We do not endorse or control these third-party resources and are not responsible for their availability, content, or accuracy.

Limitation of Liability
To the maximum extent permitted by law, New Voters shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising out of or relating to your use of the Site, even if we have been advised of the possibility of such damages.

Indemnification
You agree to indemnify, defend, and hold harmless New Voters, its directors, officers, employees, and agents from and against any claims, losses, liabilities, damages, costs, or expenses arising out of or relating to your use of the Site, violation of this Agreement, or infringement of any rights of a third party.

Modifications and Termination
We reserve the right to modify, suspend, or terminate the Site, in whole or in part, at any time without prior notice. We may also modify this Agreement from time to time. Your continued use of the Site after any modifications to this Agreement constitutes your acceptance of the modified terms.

Governing Law and Dispute Resolution
This Agreement shall be governed by and construed in accordance with the laws of Pennsylvania. The language of the arbitration shall be English.

Email Collection and Marketing
(a) Email Submissions: New Voters may provide forms on the Site that allow you to submit your email address for the purpose of receiving newsletters, updates, and other marketing communications. By submitting your email address through these forms, you consent to receive such communications from New Voters.
(b) Opt-out: If you no longer wish to receive marketing communications from New Voters, you can unsubscribe or opt-out by following the instructions provided in the emails or by contacting us directly. Please note that even if you opt-out of marketing communications, we may still send you transactional or administrative messages related to your use of the Site.
(c) Protection of Personal Information: We value your privacy and will handle your personal information in accordance with our Privacy Policy. We take reasonable measures to protect your personal information and prevent unauthorized access, use, or disclosure.
(d) Third-Party Service Providers: We may engage third-party service providers to assist with email marketing campaigns. These service providers are bound by confidentiality agreements and are prohibited from using your personal information for any purpose other than providing services to New Voters.
(e) Compliance with Applicable Laws: New Voters complies with all applicable laws and regulations regarding email marketing, including anti-spam laws. We will not sell, rent, or lease your email address to third parties without your consent.
(f) Responsibility of User Submissions: If you submit any content or information through forms on the Site, including but not limited to feedback, comments, or testimonials, you grant New Voters a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, adapt, publish, translate, distribute, and display such content for promotional or marketing purposes.
(g) Accuracy of Information: You are responsible for providing accurate and up-to-date information when submitting your email address or other personal details. New Voters shall not be liable for any consequences arising from the submission of incorrect or outdated information.
(h) Children's Privacy: New Voters does not knowingly collect personal information from children under the age of 13 without verifiable parental consent. If we learn that we have collected personal information from a child under the age of 13, we will take steps to promptly delete the information from our systems.
(i) Compliance with Terms: By submitting your email address or other personal information through forms on the Site, you acknowledge and agree to comply with the terms and conditions of this Agreement, including the provisions regarding email collection and marketing.
(j) Changes to Email Collection and Marketing: New Voters reserves the right to modify or update its email collection and marketing practices at any time. Any changes will be reflected in an updated version of this Agreement.By submitting your email address or other personal information through forms on the Site, you acknowledge and consent to the collection, use, and disclosure of your information as described in this Agreement and our Privacy Policy.This section governs the collection of email addresses and their use for marketing purposes, ensuring transparency and compliance with applicable laws and regulations.

Entire Agreement
